Background on the city of Qamishli, located to the north-east on the Syrian border with Turkey and close to the foot of the Taurus Mountains, along the Turkish city of Nusaybin. The climate of the city of Qamishli is also characterized by a semi-arid medium climate, where the climate is hot and dry in summer, cold and rainy in winter, and in spring it is moderate and rainy intermittently. As a result, ambulances and security forces of the Autonomous Administration (Asayiş) rushed to the (Western Neighborhood) area, where dozens of wounded and victims were transferred to private hospitals, including: Al-Salam, Al-Nour, Nafez, Dar Al-Shifaa and the National Hospital in the city.

I did not see the truck bomb, and during the explosion, the sound of bullets came. I was telling myself if we did not die with the bombing, we will die by the bullets.

- When we asked about the distance between the Asayish center and the place of the explosion, he replied: The distance of the explosion between me and the Kamal Koreh store was 20 meters. The explosion was very far from the Asayish headquarters, in my opinion, it was not targeting the Asayish or the rest of the Autonomous Administration departments, because the closest center to the scene of the accident was at least 100 meters for that. I doubt that the aim of the bombing was to target the Autonomous Administration centers, which were actually only a weak percentage affected.
I also inform you that before the explosion, a warplane flew over the area for about 10 minutes. The plane was very low. Which aims only to kill innocents with the aim of spreading terror and panic among the safe, and since there is no comprehensive definition of terrorism and terrorist acts, but they all agree that terrorist acts are those acts that aim to spread terror, panic and fear in the hearts of the safe...

As it appears from the site of the operation and all the cases that were documented that it targeted civilians as such, which gives the action the status of crimes against humanity, which means any act committed as part of a large-scale attack directed against any group of the civilian population. A crime against humanity is committed by one of the following:
Intentional murder.
Annihilation.
- Slavery.
Deportation or forced transfer of residents.
Imprisonment or severe deprivation.
- Torture.
Rape, sexual slavery, or enforced prostitution.
Persecution of any specific group or group of people on political, racial, national, ethnic, cultural or religious grounds.

2 - The moral pillar,
Availability of the general criminal intent only is sufficient for the crime to occur, and the general intent is represented by knowledge and will.
In this case, the general element suffices, i.e. the offender’s knowledge and will to commit the crime, and according to the text of Article 8 of the Rome Statute, which is the system of the International Criminal Court, the court is competent to consider crimes that are considered war crimes.
Also, according to the chapter of Article 1 of the Convention on the non-statutory limitation for war crimes and crimes against humanity, both crimes are war crimes and crimes against humanity, regardless of when they were committed.
Likewise, the operation targeted an ethnic group by virtue of its character, since the place of carrying out the terrorist operation in it was a purely Kurdish area, and therefore the aim of it was to kill and liquidate the largest possible number of the people of this component. Genocide means any act committed with intent to destroy a national, ethnic, racial or religious group in whole or in part, including:
Kill the group members.
Inflicting physical or mental harm on them.
Deliberately subjecting them to deplorable living conditions.
- Imposing measures to prevent childbearing.
Transferring children to other groups.
Organization opinion:

We in the Kurdish Organization for Human Rights in Syria (DAD), condemn and denounce the bloody violence, terrorist bombings, indiscriminate bombing and bloody clashes that strike the various Syrian regions and villages in general, and the indigenous components and minorities in Syria in particular, where the most heinous types of murder and the most heinous barbaric crimes against humanity and history are committed. Human rights through the use of various types of weapons of destruction, killing tools, bloody explosions and indiscriminate bombing, as these inhumane practices and measures have become clear forms of persecution and ethnic cleansing. The bombing of the western neighborhood of Qamishli was only part of those bloody terrorist acts that contradict all human, moral and religious values.
We also, as we declare our full solidarity with the families of the victims and those affected, and extend our heartfelt and heartfelt condolences to all those who died in the bombing, wishing all the wounded a speedy recovery, and registering our condemnation and denunciation of all practices of violence, killing, assassination and enforced disappearance committed by the normal regime and ISIS militants. We also appeal to all regional and international parties concerned to assume their responsibilities towards the people of Syria and the future of the region as a whole, and we call on them to work seriously and quickly to reach a peaceful political solution to the Syrian crisis and to stop the bloodshed and destruction.
Recommendations:
1 - The organization addresses the international community, which adopted the UN Security Council resolution on Friday 15/8/2014 formulated under Chapter VII targeting “extremist Islamists” in Syria and Iraq, by bypassing the traditional techniques adopted to combat terrorism and based on the use of force, such as air strikes targeting areas The work of terrorist groups, liquidating their leaders and members, engaging in direct battles with their supporters, and taking collective coercive steps against their potential followers. External intervention will not suffice in the fight against the Islamic State. If it is not coincident with the disclosure of the foundations and premises on which the organization depends, and its supporters and financiers, financially, morally, media and politically, and exposing the organization’s preferred narrative of the Islamic Caliphate and its necessity for the peoples of the region for their development and development. By clarifying the actions of terrorist and criminal groups to local communities. The organization's narrative should also be dismantled by highlighting the incompatibility of its creed with the values ​​of Islam. The behavior of the Islamic state as if it were a state in its own right must be reversed.
- It also directs to the international community the need to assume its humanitarian responsibilities towards civilians who are victims of ISIS attacks and its control over cities and towns and emptying them of their residents, who have become displaced in many other cities.
2 - Forming a fact-finding committee to find out the merits of this crime, unravel its circumstances, and identify the criminals whenever possible so that this tragedy does not happen again.
3 - Forming a legal committee to compensate the victims and their families for this horrific massacre.
4 - Addressing all parties to the conflict in Syria in order to spare civilians from all forms of conflict and to preserve private and public property.
5- Immediate cessation of all acts of violence, killing and bloodshed in the Syrian streets in general, and in the Kurdish regions in particular, whatever the sources of this violence and its legislation and whatever its forms of support and justifications may be.
6 - Immediate cessation of all racist and repressive practices that adopt methods of ethnic cleansing against the Syrian Kurds, and all ethnic and religious components.
7- Popular and human rights work from all components of Syrian society, especially in the Kurdish-majority areas, in order to confront and stop the increasing risks as a result of racist practices that depend on forced and violent displacement in order to empty the Kurdish areas of their original inhabitants, and to stand firmly in the face of all practices that adopt To change the demographic structures in order to achieve ethnic and racial goals and interests, and to disintegrate it would strike all the foundations of civil peace and coexistence.
8- Since the Kurdish issue in Syria is a national and democratic issue par excellence, and a basic symbol of civil peace and coexistence, efforts to find a democratic and just solution based on constitutional recognition of the legitimate national rights of the Kurdish people, lifting injustice from its shoulders, and canceling all discriminatory policies and their consequences should be supported. Compensation for those affected within the framework of the unity of Syria's land and people, which necessarily applies to all Syrian components that have suffered from discriminatory policies.

9 - Meeting the life, economic and humanitarian needs of the afflicted cities and the displaced inside and outside the country, and providing them with all the necessary supplies.
10- The organizations and bodies concerned with defending the values ​​of citizenship, human rights and peaceful struggle, find safe ways and invent sound ways that contribute to spreading and consolidating the values ​​of citizenship and tolerance among Syrians of different affiliations and affiliations, provided that they are real guarantees for maintaining the unity of Syrian society and ensuring a secure democratic future for all. His children are equal without any exception.
